WHAT IS THE LEGALITY OF HYDRAA?
HOW IS RANGANATH APPOINTED?
Crucial questions by the Telangana High Court. Some of which I have been raising from Day1 of #HYDRAA!
During the hearing of a writ petition filed by D Lakshmi, some very important points were discussed
⁃ GO 99, issued under the executive powers of Article 162 of the Constitution, conflicts with the existing laws.
⁃ According to the GHMC Act the govt cannot delegate its statutory powers to another authority. HYDRAA is now exercising the same powers as GHMC. Why?
⁃ State’s explanation- HYDRAA is a nodal agency that will coordinate with other departments and provides ‘assistance’
⁃ Hydraa has no clear guidelines, very broad discretionary powers and absolute lack of clarity.
⁃ Also, according to the GO, HYDRAA was supposed to be led by an IAS!
⁃ Hydraa commissioner AV Ranganath is a 1995 Group 1 officer who was promoted to IPS cadre in 2006!
Justice Lakshman was not satisfied by the state’s response and directed the Additional Advocate General to appear before the court. The AAG requested time till the 30th of September to furnish everything!
I am glad the honorable court is asking all the pertinent questions!
May be, too early to celebrate…but I think this is a win against the “selective bulldozer justice”!
Meanwhile, who is going to pay for the houses that were destroyed in a PR frenzy mode? What about those who suffered severe financial, physical and mental trauma?
Who will compensate them???
