I just want to know under which provisions of the Law an institution formed under G.O.M.S No. 99 dated 19-07-2024 that is binding on the GHMC ACT can question / revoke / demolish the buildings structures that are constructed with the permissions of GHMC/HMDA/CDMA/Municipality which were given 10 to 20 years ago? Is that G.O. overrides the parent Act and gives retrospective effect?
"The GHMC Act of 1955 does not have retrospective effect unless it is expressly authorized by the Act".
Demolition or alteration of building work covered under Section 452, if the demolition or alteration of building work that is unlawful.
The Commissioner can serve a notice to show cause, confirm the order with modifications, or demolish the construction if the person does not comply.
