On 27.10.2025 hearing was held at Real Estate Appellate Tribunal, MCRHRD campus, Hyderabad in Dr Lubna Sarwath vs Phoenix Global Spaces Pvt Ltd & Ors. 

On 7.10.2025 Phoenix was instructed to file Building permissions, TGRERA registrations , all related documents, yet they were not filed.

Appellant filed rejoinder to the counter affidavit of R1 & R2.  

The Counter filed on 7.10.2025 by R1&R2 does not answer any of the grounds of the appeal, rather they gone into same rhetoric of ‘maintainability’ of appellant,  etc.

Prima facie analysis shows that at the date of TGRERA Order dt. 27.03.2025 the

said survey numbers 272 and 273 Puppalguda V Gandipet M, RR District, were held in Prohibited List which was blatantly denied in the TGRERA Order, that clearly indicates the collapse of TGRERA Order and exposes the unfairness of TGRERA order and all the Respondents.

Secondly, it is observed that R1 hastens with another letter to get the said survey numbers

to the said extent to be deleted from Prohibited List after this Appeal is filed in this Hon’ble

Tribunal. The said District Registrar obliges by a mere letter from the Tahsildar. All due procedure

has been manipulated by the Respondents.

As the Respondents private and state are seen to be colluding with one another it is

appealed once again to the Tribunal that the TGRERA Registrations be suspended pending thorough investigation, to save allottee interests that is one of the primary objectives of the RERA Act 2016 and objective of this Hon’ble Tribunal.
