TGRERA's ERRONEOUS , ARBITRARY ORDER

APPEAL IS FILED IN REAL ESTATE TRIBUNAL AGAINST TGRERA's  ERRONEOUS , ARBITRARY ORDER THAT FAVOURED PHOENIX & SUMADHURA ILLEGAL CONSTRUCTIONS - IN PROHIBITED AREA/NARSINGI LAKE-2 HMDA LAKE ID 2939

On 16th June 2025 Telangana Real Estate Appellate Tribunal, located at MCRHRD campus, Jubilee Hills, received , by Registered Parcel, an Appeal filed against the TGRERA's, erroneous, arbitrary order , that failed to render justice and wantonly favoured the illegal constructions of Phoenix Global Spaces Pvt Ltd/Sumadhura Constructions Pvt Ltd., in Prohibited Area/Narsingi Lake-2 HMDA lake id 2939


RS.5000 TRIBUNAL FEE NOT PAID, REQUESTED FOR CONDONATION

It is being placed in public domain that Rs.5000 fee to be paid to Tribunal has not been paid.  
A request has been placed before Tribunal to condone the Rs.5000 fee for two reasons: (1) as the public cause to protect allottees of 'TRITON' & 'SUMADHURA' and Narsingi lake-2 is in public interest; and (2) as Rs.5000 has already been paid earlier in Case No.A.R. 07/2025 on the same matter with the Tribunal.

FOLLOWING ARE FEW OF THE GROUNDS STATED IN APPEAL:                                                             5.4.9 BECAUSE the Authority , not acting in good faith, overlooked the TGIIC permit that states the permit automatically cancelled if court cases on the subject
lands: ’46. Any court cases/Litigations found in future pertaining to the subject lands in Sy. No the proposals for approval of Residential Building plans for construction of Three Wings and earlier Building Permit order No IIC/0229/2021 dated 06/10/2021 in Sy. No 272(P) & 273(P), Puppalaguda (V), Gandipet (M), RR District., NA, Puppalaguda (V), Gandipet (M), Rangareddy District. The building permit orders issued by the Commissioner, IALA – Puppalaguda and Zonal Manager, Cyberabad is automatically withdrawn and cancelled without any notices. ‘ (ANNEXURE 11)                                                                                                                                                                                                                                                                    5.4.12 BECAUSE the ongoing transactions are       contrary to the Act 2016 as highlighted in para 4.1 above, in which the Registrar marked a copy to ‘The Public’. (ANNEXURE 2) Sec 4(g) and Sec.4(l) reproduced below for ready reference:
* 4.Application for registration of real estate projects (g) proforma of the allotment letter, agreement for sale, and the conveyance deed proposed to be signedwith the allottees;
* 4.(l) a declaration, supported by an affidavit, which shall be signed by the promoter or any person authorised by the promoter, stating:—
* (A) that he has a legal title to the land on which the development is proposed along with legally valid documents with authentication of such title, if such land is owned by another person;
* (B) that the land is free from all encumbrances, or as the case may be details of the encumbrances on such land including any rights, title, interest or name of any party in or over such land along with details;                                                          courtesy/ source by:
